Sub:  Appointment of IO/PO in cases where disciplinary proceedings have not been initiated under Rule 18 of CCS (CCA) Rules, 1965 - reg.

 

 Sir/ Madam,

 

            I am directed to invite attention to the Board's circular of even no. dated 27.11.2007 (copy enclosed) on the above subject and to say that the said circular provides that where disciplinary authority concerned in respect of Group 'B', 'C' & 'D' officers  wishes to appoint same set of IO/PO which has been appointed  in respect of Group A officer involved in the same case, but where the proceedings have not been initiated under Rule 18 of CCS (CCA) Rules , he may appoint the same set of IO/PO with prior consultation  with the respective cadre controlling authority under whose jurisdiction the concerned IO/PO is posted.  Cadre controlling authority were  also requested to be considerate while considering such proposals in the interest of expeditious disposal of cases.

 

2.   As an IO in respect of a Group A officer has to be necessarily a Group 'A' officer and the PO in most cases is also  Group A officer,  the said circular  necessitates  a reference to the Board as cadre controlling authority for prior consultation/ concurrence.  However, it has been observed that processing of such references  is  considerably delayed in the Ministry/ DGoV.  Therefore,  with a view to  further streamline and expedite the process, it has now been decided that where the disciplinary authority for Group 'B' and  'C' employees (including  erstwhile Gr 'D' employees)  proposes to appoint same set of IO/PO as have been appointed for  a  Group 'A' officer  involved in the same case, he may seek prior concurrence of the Chief Commissioner concerned of the Zone where the said IO/PO is posted.  The Chief Commissioner concerned would give due consideration to such requests while examining the proposal in the interest of expeditious disposal of the disciplinary cases. 

 

3.     Where, however, regular Commissioner & IO has been appointed as Inquiry officer in respect of a Gr. A officer,  prior consultation of the Board/CVO would be necessary . 

 

4.   This issues with the approval of Chairman, CBEC.  The instructions dated 27.11.2007 stand modified to the above extent.
