Subject:     Revised Draft Seniority List of Assistant Commissioners of Customs and Central Excise (Group A of IRS (C&CE)  appointed up to 1996-97.

 

 

Sir / Madam,

 

I am directed to say that a  review DPC was held on 2nd January 2013 by UPSC against the quota of vacancies for Custom Appraisers in respect of the vacancy years 1980 to 1996-97 based on the revised  Seniority List of Custom Appraisers dated 16.12.2004 and 25.07.2012.

 

2.         Based on the recommendations of the said DPC held on 02/01/2013 and after obtaining approval of the competent authority, the revised Select Lists of Assistant Commissioners   against  the quota of vacancies for Custom Appraisers for the years 1980 to 1996-97 have been issued vide letter No A.23020/4/2012-Ad II dated 4th February,2013.

 

3.         Consequently, a revised draft Seniority List of Assistant Commissioners of Customs and Central Excise (Group A of IRS (C&CE)  up to 1996-97, has been prepared by adopting inter-alia the following principles:-

 

    (i)     The Officers appointed prior to 01.01.1980 have been placed in the draft seniority list based on the actual date of joining the grade of Assistant Commissioner, in accordance with the order dated 22.11.1996 of Hon'ble Supreme Court in Writ Petition No. 306/1988 in All India  Federation of Central Excise etc Vs Union of India & Ors.

 

    (ii)    The Officers appointed on or after 01.01.1980 have been placed in the draft seniority list as per the ratio of 6:1:2 for the feeder grades of Superintendents of Central Excise, Superintendent of Customs (Preventive) and Customs Appraisers, respectively, in compliance  with the order dated 22.11.1996 of Hon'ble Supreme Court in Writ Petition No. 306/1988 in All India  Federation of Central Excise etc Vs Union of India & Ors.

 

4.         The Revised Draft Seniority List will be subject to outcome of Writ Petition No. 4855 of 2004 filed by the Promotee Custom Appraisers' Association pending before the Hon'ble High Court of Bombay and any other related court cases.

5.         The draft seniority list and the revised select lists have been posted in the website of CBEC www.cbec.gov.in  under the heading 'Departmental Officers'.

6.         It is requested that the draft revised Seniority List of Assistant Commissioners of Customs and Central Excise up to 1996-97 may be duly circulated to all the concerned officers immediately. The officers concerned may be advised to file objections against the assignment of seniority as well as factual mistakes, if any,  to ADG (HRM) in the Directorate of Human Resource Development, Customs & Central Excise, 409/8, Deep Shikha Building, Rajendra Place, New Delhi 110 008 (Fax: 011- 25729871, email- dopm@rediffmail.com) , and in any case not later than 20th February, 2013.  Any representation received after 20.02.2013  will not be entertained. 

7.         It is also requested that, details of the officers, included in the revised draft seniority list, viz.  name, date of birth, category (SC/ST) and other relevant details may be got verified from the service records available in the Commissionerates and changes noticed if any may please be intimated to ADG (HRM), DG HRD, under intimation to this department. 

 

8.         A line in confirmation of the circulation of the draft seniority list and verification of the personal details from the service records may be sent to ADG (HRM), DG HRD.

 

9.         This may please be accorded 'TOP PRIORITY'.
