DIRECTORATE GENERAL OF CENTRAL EXCISE INTELLIGENCE

Section,4(1)(b)(i) Particulars of Organization, Functions and Duties.

The Directorate General  of Central Excise Intelligence with its Headquarters at New Delhi is headed by the Director General. The functions and duties are mentioned at para (ii) below.

(ii)       Powers & duties of the officers and employees:

The officers of DGCEI are empowered to discharge the functions of Central Excise and Customs officers. Their functions and duties are as under.

a.   Collection, collation and dissemination of intelligence relating to evasion of Central Excise Duties and Service Tax on an all India basis.

b.   Studying the modus operandi of evasion peculiar to excisable commodities and to alert the Commissionerates about it.

c.   Studying the price stucture, marketing patterns and classification of commodities in respect of which possibilities of evasion are likely with a view to advising the Commissionerates for plugging loopholes.

e.   Supplmenting and coordinating the efforts of the field formations in investigations in cases of evasion wherever necessary.

f.    Coordinating action with enforcement agencies like Central Economic Intelligence Bureau (CEIB), Income Tax, Sates Tax. Enforcement Directorate etc., in respect of cases in which central excise evasion has come to notice.

g.   Investigating offences involving evasion of central excise duty and Service Tax having ramifications in one or more than one Commissionerates including investigation of complicated cases selected by the Directorate or entrusted to it by the Ministry.

h.   Having at all time, a complete destailed & up-to-date of the Taxation Laws and implementation machinery and to have proper appreciation and assessment of possibilities of evasion.

i.    Assisting in advisory capacity in proper deployment of the Central Excise anti-evasion staff in the Central Excise Commissionerates for effective anti-evasion measures.

j.    Examining and studying the effects and implementation of various tax concesssions, exemptions and relaxations in controls and to make recommendations to the Government from time to time, to ensure that they do not become a source of evasion.

k.   Maintaining liaison with other Central & State agencies in all matters pertaining to tax evasion.

(iii)      The procedure followed in the decision making process, including channels of supervision and accountability

            The channel of movement  of paper is Superintendent - Assistant/Deputy Director (If required) - Joint/Additional Director (If required) - Additional Director General - Director General (If required)

(iv)      The norms set by it for the discharge of its functions:

            The norms are set by the supervisory authority to be followed by all the subordinate officers after due deleberations on all aspects of intelligence and the manner of its excutions.

(v)        Rules, regulations, instructions, manuals & records held by it or under its control for being used by the employees for discharging its functions:

(a)  Rules and regulations:- Central Excise Act. 1944 and rules made there under and Finance Act, 1994 and rules made there under

(b)  Instruction and Manual  - CBEC's Excise Manual of supplementary Instructions and Board's Circulars issued from time to time.

(c)  Records:-  As required under manuals and instructions mentioned in para (v) (b) above

(vi)      A statement of the categories of documents that are held by it or under its control

            Documents prescribed under Manuals and instruction mentioned as in para v (b), above

(vii)     The particualars of any arrangement that exists for consultation with, or representation by the members of the public in relation to the formulation of its policy or implementation thereof

            Being an Investigating and Intelligence agency, there is no mechanism of consultation with public.

(viii)    A statement of the Boards, Councils, Committees and other bodies consisting of two or more persons constituted as its part or for the purpose of its advise, and as to whether meetings of those Boards, Councils, Committees and other bodies are open to the public, or the Minutes of such meetings are accessible for public
