Directorate  General of Export Promotion,

Section,4 (1) (b) (i) The particulars of its organization, functions and duties:

(i) The charter of functions and duties assigned to this Directorate General are as under : 

I.

Work relating to the following Export Promotion Schemes (both Customs and Central Excise).

 

(i)                  100 % Export Oriented Units.

(ii)                 Special Economic Zones (including work relating to erstwhile free Trade Zones and Export Processing Zones).

(iii)               Special Jewellery Complexes and Gem and Jewellery Export Promotion   Schemes.

(iv)                Software Technology Park and ElectronicHardware Technology Park Schemes.

II.

 Monitoring of the Export Promotion Schemes as at Item No. (1.), analysis of periodical reports/ returns / statistics, and legislative work relating to the above schemes (both Customs and Central Excise).

III.

Meeting of the Foreign Investment Promotion Board (FIPB), Boards of Approval (BOA) for EOU/ SEZ, Inter-Ministerial Standing Committee (IMSC) in the Department of Information Technology etc., meetings with DGFT/Ministry of Commerce on matters relating to above Export Promotion Schemes and interaction with Trade including Export Promotion Councils.

IV.

Act as a central consultative body with the trade and other stakeholders (Trade Associations and Chambers of Commerce such as FIEO, Federation of Freight Forwarders Associations of India, Air Cargo Agents Association of India, National Association of Container Freight Stations, Export Promotion Councils, Indian Ports Association, etc.) and suggest changes in Customs clearance procedures with a view to facilitate international trade, wherever necessary.

V.

Review Customs trade facilitation measures from time to time with a view to evaluate their efficacy and suggest further improvements

VI.

 Study the best international practices concerning Customs clearance procedures for their adoption

VII.

Over-see and analyze the dwell time for clearance of import / export cargo at various major ports, airports, ICDs, etc. and, as appropriate, make recommendations relating to clearance procedures followed by Customs and other agencies, with a view to reduce dwell time.

VIII.

Review the trade facilitation initiatives of the Custom Houses and other field formation e.g.

- Review the working of the Drawback Committees/ Regional Advisory   Committees/ EDI Committee/ Watch Dog Committees, etc. in the various customs field formations for any modification in law and procedures

- Monitor the maintenance and updating of the websites of the Customs Commissionerates / Customs Houses.

For performing the above functions, DGEP is empowered to seek and obtain information from all customs field formations. DGEP's function would be limited to policy level issues and it would not address individual grievances relating to customs Trade facilitation (like delays in assessment of Bill of Entry, grant of refund, etc.).

Where the issue under consideration also impinges on the functioning of other wings such as the Directorate of Systems, Directorate General of Inspection, Directorate of Drawback or the relevant sections of the Board's office, DGEP will function in consultation with these relevant Sections/ Directorates. In all such matters DGEP would function as a coordinator to address the issue(s) at hand.

ii)       The powers and duties of its officers and employees:

No specific power under any Act has been given to the officers under this Directorate General. With respect to the duties, the variuos functions as enumerated above are to be carried out by seeking various information, data, reports from the field formations under CBEC, industry and other available sources.

(iii)      The procedure followed in the decision making process:

The hierarchy of the organization is as follows:

DG - ADG - Additional Director - Assistant Director - Sr. Intelligence Officer - Intelligence Officer.

With regard to Administrative matters proposals/action to be taken are processed at the section level and put up to Assistant Director - Additional Director and finally approved by Additional Director General, under overall supervision and control of Director General.

With regard to functions other than Administration the issues/decisions are initially processed by I.O./SIO and put up to D.G. for approval through Assistant Director - Additioal Director - Additional Director General.

(iv)      The norms set by it for the discharge of its functions:

This Directorate is analyzing the duty foregone statements received from field formations and Directorate of Data Management and submitting comprehensive report to the Board. The norms set are that the analysis and the data should be accurate and brief.

This Directorate General is also entrusted with the function of attending to grievances of genuine exporters. The officers should be prompt in attending the genuine grievances.

The norms set at various levels are to collect authentic data and analyze the same correctly.

(v)        The rules, regulations, instructions, manuals and records, held by it or under its control or used by its employees for discharging its functions:

Customs Act 1962, Central Excise & Salt Act 1944 and related other allied Acts, Rules and Regulations along with Foreign Trade Policy 2002 - 2007.

(vi)      Statement of the categories of documents that are held by it or under its control:

(i)     Day to day administration related files for running the office;

(ii)   Files related to specific issues on export promotion measures, Export Promotions Schemes, Meetings with various Export Promotion bodies and councils, analysis of duty forgone etc.

(vii)     The particulars of any arrangements that exists for consultation with or representation by the members of the public in relation to the formulation of its policy or implementation thereof.

Any general public, trade Export Promotion Councils can visit the office during the working days and during the working hours and obtain any information from this office on the related issues.

(viii)    Statement of the boards, councils, committees and other bodies consisting of two or more persons constituted as its part or for the purpose of its advise, and as to whether meetings of those boards, councils, committees and other bodies are open to the public, or the minutes of such meetings are accessible for public.

No boards, councils, committees and other bodies are formed under this Directorate  General.

(ix) Directory of its offices and employees

(x) Monthly remuneration received by each of its officers and employees, including the system of compensation as provided in its regulations
