Directorate General of Service Tax Mumbai

Section,4. (1) (b) (i) The particulars of its organization, functions and duties:

The Directorate General of Service Tax is headed by a Director General. Who is an officer of Indian Revenue Service (Custom and Central Excise). 1 Additional Director General of the rank of commissioner/joint Secretary (Central Government), 2 Additional Directors of the rank of  Additional Commissioner (Director rank. of Central Government) and 4 Deputy/Assistant Directors are posted at office located at Directorate. 9th Floor, Piramal Chambers, Lalbaug, Parel, Mumbai- 400 012

Functions:

The office of Director General (Service Tax) has been formed in the year 1997. It is headed  by the Director General (Service Tax.) The functions of Director General (Service Tax) are:

(i)      To ensure that proper establishment and infrastructure has been created under different central excise Commissionerate to monitor the collection and assessment of service tax.

(ii)       To study the staff requirement at field level for proper and effective implementation of service tax.

(iii)      To study as to how the various service taxes are being implemented in the field and to suggest measures as may be necessary to increase revenue collection or to streamline procedures;

(iv)       To undertake study of law and procedures in relation to service tax with a view to simplify the service tax collection and assessment and make suggestions thereon;

(v)       To form a data base regarding the collection of service tax from the date of its inception in 1994 and to monitor the revenue collection from service tax.;

(vi)      To inspect the service tax cells in the commissionerate to ensure that they are functioning effectively:

(vii)      To undertake any other functions as assigned by the Board from time to time.

Duties

The officers are performing duties for discharging the above functions of the Directorate. The work is distributed by specifying the following major work in the Directorate:-

(i)       Compilation of information especially revenue data;

(ii)      Technical matters relating to study of law and procedures and dealing with references to and from the Board/Ministry and also field formations-on general service tax laws and procedures.

(iii)     Service providers-study of legal implications, references to the Ministry of matters having all India ramification, clarification of specific nature to field formations, reply to Association.

(iv)      Inspection of selected service tax formations

(v)       Issuing modus operandi circulars;

(vi)      Suggestion to the Ministry for creating proper establishment and infrastructure for service tax formations;

(vii)      Administration of the Directorate.

(ii)       Powers & duties of the officers and employees:

    same as above - assisting the Board.

(iii)      The procedure followed in the decision making process, including channels of supervision and accountability

                The issues are examined by the Directorate and recommendations are made to the Board/Ministry with the approval of the Director General. The issues of specific nature, covered by existing law and circulars/letters of the Board/Ministry are clarified to the field formations with the approval of the Director General. The Directorate functions under the supervision of the Board and is accountable to the Board.

(iv)      The norms set by it for the discharge of its functions:

                Same norms and specified  in the Citizen's Charter and Mission Statement as announced by the CBEC are followed.

(v)        Rules, regulations, instructions, manuals & records held by it or under its control for being used by the employees for discharging its functions:

                The same as prescribed by CBEC. The CBEC web-site is containing details relating to service tax and this Directorate.

(vi)      A statement of the categories of documents that are held by it or under its control

                References received from the field formations and trade and associations- The Directorate is not having any public dealing as such.

(vii)     The particulars of any arrangement that exists for consultation with, or representation by the members of the public in relation to the formulation of its policy or implementation thereof

                Same as CBEC. The Directorate is assisting the Board in policy matters, but do not make any policy decisions on its own. The consultation with the associations, trade bodies etc. are purely on specific issues and on ad-hoc basis (as and when required).

(viii)    A statement of the Boards, Councils, Committees and other bodies consisting of two or more persons constituted as its part or for the purpose of its advise, and as to whether meetings of those Boards, Councils, Committees and other bodies are open to the public, or the Minutes of such meetings are accessible for public
