( Central Board of Excise & Customs )

North Block, New Delhi

Dated, the 7th July, 2009

Shri R.M. Ramchandani,

Chief Commissioner of Central Excise(Mumbai Zone-I),

Central Excise Building,

115, M.K. Road, Churchgate,

Mumbai - 20

Subject:   Posting of officers and staff to LTU - Clarification on rotation of Group 'A' officers - regarding

I am directed to refer to your letter No.II/3-6/Admn/CCO/MCX-I/09 dated 01/06/2009 seeking clarification regarding combining of service rendered by an officer in LTU  with his earlier tenure in Central Excise for the purpose of computing his tenure of two years for local rotation  from Central Excise to Customs as per para 4.7 of the Transfer Policy of Group 'A' Officers of Customs & Central Excise.

2.         The matter has been examined.  Para 4.7 of the Transfer Policy provides that officers will, as far as possible, be rotated between the Customs and Central Excise branches every two years and adequate experience in Service Tax branch will also be ensured as far as possible.  It is not mandatory that an officer will be transferred to Customs formation immediately on completion of tenure in the Central Excise, nor can an officer claim it as a matter of right to transfer him to Customs as soon as he completes two years tenure in the Central Excise.  The administrative requirements have to be kept in mind while considering transfers from one formation to the other.

3.         As regards counting of tenure in LTU alongwith preceding tenure in Central Excise for purpose of computing two years tenure in Central Excise, it is clarified that it is not necessary that each and every officer should be posted both in the Central Excise as well as in the LTU.  Posting in an LTU is an important assignment and, therefore, once an officer is posted there, he must serve there at least two years before being considered for rotation in other field formations, irrespective of his tenure immediately preceding his posting in the LTU.

Yours faithfully,

( R. Sanehwal )

Dy.  Secretary to the Govt. of India
